Vitter Challenges ‘Who Dat’ Claimants

NEW ORLEANS — U.S. Sen. David Vitter is taunting the latest group to claim ownership of the phrase “Who Dat,” sending a letter that tells the company to drop its trademark lawsuit or meet him in court.Vitter jumped into the fray over the popular Saints chant by sending two of his T-shirts to the owners of the company, “Who Dat? Inc.” The T-shirts, printed earlier this year when the NFL asked shop owners to stop selling Who Dat merchandise, say “Who Dat say we can’t print Who Dat! © TM 2010 David Vitter (just kidding)””You’re kidding, right? Claiming you own the legal rights to the term ‘Who Dat’?” Vitter wrote in his letter to the company.

Body language a big part of Sean Payton’s coaching curriculum with New Orleans Saints

Jeff Duncan, TP

SAN FRANCISCO – As I watched San Diego Chargers quarterback Philip Rivers throw a conniption fit at midfield in Kansas City last week a thought occurred to me.

This would never happen with the New Orleans Saints.

I can’t remember the last time a Saints player lost it on the field. Of course, there’s not a lot to get upset about when you start a season 13-0 and win the Super Bowl.

Still, the Saints, by and large, are as demonstrative and emotional as snipers when they take the field. Their insides might be bubbling cauldrons of emotion but it rarely shows.

The closest thing I can remember to a visual display of on-field emotion in the Sean Payton era was the heated sideline exchange between tight end Jeremy Shockey and quarterback Drew Brees in Atlanta two years ago.

Otherwise, nothing.

NFL power rankings: New Orleans Saints remain No. 1

Nakia Hogan, The Times-Picayune

The New Orleans Saints weren’t as impressive as some fans would have liked them to be, but they are still plenty good enough.

In beating the Minnesota Vikings 14-9 Thursday night, they proved they could win an ugly game as well as in style. So, for the second straight week, the defending Super Bowl champions are the No.1-ranked team in the NFL Power Rankings by The Times-Picayune.

There is a new No. 2 team, however. The Green Bay Packers have moved up three spots to the second position, followed by the New England Patriots and Baltimore Ravens.

MORE… interesting comments from the Who Dat Nation about who “owns” Who Dat.

butterbeer September 16, 2010 at 10:52PM

who knows who said “who dat” for the first time, but we all know its not this fool from Texas. All the defendants have to do is ask for a jury and they will NEVER get a dime. WHO DAT!!!!!!!!!!

nanunanu September 16, 2010 at 11:05PM

Monistere has no legal case. This has already been established. I think it is interesting that he had to go all the way to San Antonio to find a lawyer to take this sham of a case. It really is a shame that he is wasting other peoples time on this stupidity.

kamar September 16, 2010 at 11:07PM

Hmmm, after 27 years of “owning” the trademark to the phrase this fool finally decides to sue?

I would think that standing idly by all these years would suggest his tacit approval of free use of the phrase.

TheSixWardGhostWontDie2 September 16, 2010 at 11:07PM

If the saints record was 0-16 in the last 3 seasons,,none of these clowns would be trying to claiming WHO DAT….

GET A LIFE YOU IGNORANT PERSON! It’s all in good fun. They say dat to have fun bc we are from the South & it’s how some talk when speaking fast. I can’t not fathom how mean your are for posting something like this! We are the only team in the NFL that has fun sayings to chant as a crowd. The crunk song, it’s great fun, even my grandmother dances to it. WOW you do call yourself a Saints fan but can’t appreciate fun. You must be one boring person WITH ABSOLUTELY HORRID COMPANY. You actually sound more stupid than any of the above mentioned phrases you have pointed out. If we stole a song from anyone, wait wait I’m thinking the YING YANG TWINS not the falcons. I’m pretty sure the song was customized for us right….I could go on & on about your ignorant post but more so I’m going to laugh at you with the rest of THE WHO DAT FANS THAT READ YOUR POST! Go on with your boring life bc you ARE NOT a true Saints fan!! WHO DAT! WHO DAT SEY DEY GONNA BEAT DEM SAINTS! STAND UP AND GET CRUNK!!!

WHO DAT NATION! RISE AND TELL THOSE JERKS TO BACK OFF! GEAUX FLEURTY GIRL AND STORYVILLE APPAREL AND ANY OTHER MERCHANT/FAN WHO USES WHO DAT! kamar and thesixwardghostwontdie2 hit the nail on the head with their remarks! WHO DAT! WHO DAT! WHO DAT! WE DAT!

teegirl September 16, 2010 at 11:26PM

I agree. Where has he been all these years? We didn’t just start saying ‘Who Dat’ last season! What a jerk! So I can go trademark a phrase and ‘own’ it. How ridiculous! If the NFL backed down over the public outcry, then this guy doesn’t have a chance. I suggest people boycott his ‘who dat’ products that he sells in retail outlets in the area. Greedy S.O.B.!

brtboss September 16, 2010 at 11:47PM

Alot of people are fair weather Saints fans. Once the Saints started doing good people came from everywhere. If they start doing bad again, those same fans will start trash talking, bringing their bags, and stop wearing their jerseys. As far as the WHO DAT goes, this guy seen an opportunity to make some money since the Saints are Super Bowl Champs. I also feel that all these people who opened up the stores, boutiques, and kiosks are just as guilty as this guy because they are doing the same thing. Where were all these people at when the Saints weren’t so hot? In the words of Rapper Mike Jones, “Back then they didn’t want em…Now they hot, they all on em” Now, with that said, I’m not saying it’s wrong to be a fan or become a new fan, just don’t act like you own something that you despised in the previous years under past coaches/players.

Analyst: ‘Who Dat’ Ownership Debate Will Head To Court

SLIDELL, La. — The fate of the ownership of the popular “Who Dat” phrase will soon be decided on in court as the people claiming trademark ownership on the chant have asked a federal judge to weigh in on the issue, a legal analyst said on Friday.Legal analyst Chick Foret said the Monistere brothers asked for a jury trial on the issue.“The case is pending in front of Federal Judge Carl Barbier, and the most interesting thing about this case is that the plaintiff, Who Dat Inc., has asked for a jury trial. So Who Dats themselves will decide who owns ‘Who Dat,’” Foret said.

Interesting Comments from the Who Dat Nation about who “owns” Who Dat.

The drama has started again. The comment sections across various Who Dat Nation forums, message boards, and newspapers have been pretty one sided…. It is apparent that the Monistere brothers failed to understand the kind of storm they have created by threatening the Who Dat Nation.

Did Monistere send a warning letter to Drew Brees when he told everyone that would be in the Dome on Thursday night to yell the Who Dat chant after the coin toss? Drew made that statement on nationally televised programming and on radio. That should be major infringement shouldn’t it?
Monistere wants to go after the small people. His original trademark, which he let expire, expired many, many years ago when the Saints were not good.
Hell, from what I hear, he’s lived in San Antonio most his life and hasn’t done anything with “his” supposed Who Dat until the recent success of OUR New Orleans Saints in the late 2000’s.

Open letter to Monistere:

Leave our city, our team alone. We never left our city or never stopped watching the Saints on tv every Sunday , unlike you Mr. Monistere. Get over it. You fumbled and the city of New Orleans and its RESIDENTS picked the ball up and scored. Your loss. Now stop being a sore loser and go home.

You might own the rights to the song “Who Dat” but NO ONE owns the words “Who” and “Dat” (and “dat” is not even a real word — I mean, I know it is for Saints fans in New Orleans, but…) These guys are now acting like the NFL – complete jerks. Come on into the Dome and try and tell 70,000 fans not to do the “Who Dat” chant and see what happens. Uh, yeah — good luck with “dat” one.

PURE GREED!!! I say everyone should give him your opinion via his website or FB page. He’s not hard to find. I think he should reconsider the lawsuits or his name is mud in this town.

It seems that this guy copyrighted a phrase that was pretty much public domain , because he got somebody to record a song based on the chant. Then he sat on it for more than 25 years ’til the Saints became a championship team , and now the jerk wants to get paid. I’m no legal expert , but if I was on the jury , I’d look at those facts and rule against him.
Please remember , no matter how cheap they might get , don’t buy that Who Dat cd with the Aaron Neville and the Singing Saints. Nothing against Aaron , but I don’t want Monistere to make another nickel. He didn’t create anything , but now , he wants to get rich off others’ creativity.

New Orleans Saints special teams making strides

John DeShazier, The Times-Picayune

It was one game, Pierson Prioleau cautioned.
So there’s no reason for the New Orleans Saints’ special team coverers to act as if, collectively, they’ve become a blanket. There is no reason to declare their problems have been solved, and that 25- and 50-yard punt and kickoff returns are things of the past.

But even a 12-year veteran safety such as Prioleau, the Saints’ special teams captain, is allowed to be encouraged.

“It’s fair to say we made some improvements from the preseason to the first game of the season, ” Prioleau said. “We just flat-out covered the ball better in the first game of the season.
